Terms & Conditions of Service

1. Acceptance of Terms
Welcome to Green Lawn Care & Landscape Inc. ("Company," "we," "us," or "our"). By accessing or using our website, submitting a quote request, signing an estimate or proposal, or engaging our services in any capacity, you ("Customer," "you," or "your") agree to be legally bound by these Terms & Conditions of Service ("Terms"), together with our Privacy Policy. If you do not agree to these Terms, do not use our website or services.
2. Definitions
- "Agreement" means a signed estimate, proposal, contract, or work order issued by the Company and accepted by the Customer, either by written signature, electronic signature, email confirmation, text message confirmation, or verbal authorization recorded in our CRM.
- "Services" means all landscaping, hardscaping, lawn maintenance, irrigation, snow removal, ice management, utility trenching, and related property services offered by the Company.
- "Property" means the Customer's project site where Services are to be performed.
3. Service Agreement & Continuity
- Continuous Service: All signed lawn maintenance agreements are considered continuous and shall renew season-to-season unless cancelled in writing.
- Right of Refusal: The Company reserves the right to stop or refuse services at any point. We reserve the right to cancel services immediately if legal action is threatened or if the work environment is deemed unsafe.
- Scope of Work: Only items explicitly listed in a signed proposal are included. Verbal discussions do not constitute a change in scope unless added in writing via a Change Order.
4. Pricing, Payments, and Fees
- Standard Rates: Landscape labor is charged at $85.00 per worker, per hour.
- Sprinkler Repair Rates:
- Standard Service Call: $120.00 minimum.
- Additional Time: $30.00 for every 15-minute interval after the first hour.
- Two-Worker Rate (Large Jobs): $220.00 per hour.
- Emergency Calls: $200.00 minimum.
- Note: Sprinkler parts are billed separately and are not included in hourly rates.
- Disposal & Delivery Fees:
- Dump Fee: Billed per two (2) yards of material. Final dump fees will be determined and added to the invoice once disposal is complete.
- Mixed/Heavy Loads: Subject to variable and increased pricing depending on the composition of the waste stream.
- Material Pick-up: All pick-ups from suppliers incur a $125.00 pick-up and delivery fee.
Variable Fuel Surcharge Policy
The Company utilizes a tiered fuel surcharge program to offset extreme volatility in fuel prices without permanently raising our base service rates. Surcharges are determined by the weekly regional retail average for either On-Highway Diesel Fuel or Regular Gasoline (whichever is higher), as published by the U.S. Energy Information Administration (EIA).
The surcharge is based on regional energy costs required to support our multi-vehicle fleet and will appear as a distinct line item on your invoice, regardless of the specific vehicle dispatched to your property. Because fuel consumption varies by service type, surcharges are calculated using one of the two methods below:
A. Landscape Installation & Construction Jobs
For larger landscape projects requiring heavy equipment and transport, surcharges are calculated as a percentage of the total invoice amount based on the following weekly fuel brackets:
- Fuel price below $3.50 / gallon: 0.0% Surcharge
- Fuel price $3.50 to $3.99 / gallon: 1.5% Surcharge
- Fuel price $4.00 to $4.49 / gallon: 2.5% Surcharge
- Fuel price $4.50 / gallon or above: 3.5% Surcharge
B. Maintenance Services & Sprinkler Repairs
For routine maintenance, minor service visits, and irrigation repairs, a flat-rate fee per service visit is applied to cover baseline travel and dispatch costs based on the following weekly fuel brackets:
- Fuel price below $3.50 / gallon: $0.00 Surcharge per visit
- Fuel price $3.50 to $3.99 / gallon: $1.50 Surcharge per visit
- Fuel price $4.00 to $4.49 / gallon: $2.00 Surcharge per visit
- Fuel price $4.50 / gallon or above: $2.50 Surcharge per visit
- Credit Card Fees:
- Payments $0–$100: $4.00 flat fee.
- Payments $101+: 4% processing fee.
- Port-to-Port Billing: Charges include loading time, drive time to/from the job site, dump trips, and unloading at the Company shop.
- Late Payments: Invoices are due upon receipt unless otherwise specified. All winter/snow removal invoices are strictly due within ten (10) days of the invoice date. Overdue accounts incur a fee of 1.5% per month (18% per annum), and services will be immediately suspended.
- Collection & Legal Costs: If an account remains unpaid past 60 days and is referred to legal counsel or a collection agency, the Customer agrees to pay all reasonable attorney fees, court costs, and collection agency fees incurred by the Company to recover the debt.
5. Estimates & Material Volatility
All estimates are valid for
thirty (30) days. Authorization to proceed may be granted via written signature, electronic signature, email, text message, or verbal confirmation documented in our CRM. Due to market fluctuations, if the cost of raw materials (e.g., PVC, fuel, lumber, stone) increases by more than
10% between the date of the signed Agreement and the date of installation, the Company reserves the right to adjust the contract price to reflect the difference.
6. Cancellations and Changes
- Notification: Cancellations must be submitted in writing (email or mail).
- Timelines: Maintenance requires 24-hour notice. Project work requires 72-hour notice.
- Fees: Cancellations after materials have been ordered will result in the Customer being held responsible for all material costs plus a 25% restocking and administrative fee. Change orders carry a $150.00 minimum charge plus additional time and materials.
7. Property Access & Liability
- Underground Utilities: The Customer must mark property pins. The Company is NOT responsible for damage to lines not marked by Dig Line (811) or the homeowner (e.g., sprinkler lines, clock wires, electrical, or satellite cables).
- Ground Conditions: Estimates assume standard soil conditions. Unforeseen subsurface ground conditions—including but not limited to hard clay, subterranean rock shelves, buried concrete slurry, stumps, or hidden debris—may require specialized equipment or extra labor and will result in additional costs billed to the Customer.
- Heavy Machinery: The Company is not liable for damage to existing cement, asphalt, lawn, or sprinklers caused by the weight or movement of heavy machinery required to complete a landscaping project.
- Water & Mold Issues: The Company is not liable for environmental issues, including mold growth, fungal patches, flooding, or water pooling on the property, except in cases of proven gross negligence.
- Pet Waste: All pet waste must be removed prior to arrival. Failure to do so may result in a clean-up fee or the skipping of the service area at the Company’s discretion.
8. Warranties (General)
- General Workmanship: We provide a one (1) year workmanship warranty on installation projects. This does not cover "Acts of God," natural settling, frost heave, or lack of customer maintenance.
- Plant Warranty: Moving trees or shrubs from their original placement more than once voids all survival guarantees.
- 5-Year Irrigation Warranty: New systems carry a Five (5) Year Warranty on parts and labor ONLY if Annual Spring Turn-On and Annual Fall Winterization (Blowout) are performed exclusively by the Company every consecutive year. Any third-party work or self-service voids this warranty immediately.
9.
Winter Service Terms & Ice Management
- Snow & Ice Rates: All standard winter operations are billed hourly with a one (1) hour minimum per worker. Rates are configured as follows:
- Plow Trucks & Icy Night Response: $105.00 per hour.
- Sidewalk Four-Wheelers: $75.00 per hour.
- Hand Shoveling Crews: $85.00 per hour.
- Heavy Equipment (Backhoe / Dump Truck): $130.00 per hour.
- Deicing Materials: $3.95 per gallon for Liquid Deicer / $0.93 per pound for Granular Deicer.
- Nightly Storm Inspections:
$28.00 per occurrence (maximum 1 per day when conditions warrant).
Note: A baseline daily $5.00 inspection and monitoring fee applies from November 1st to February 28th. - Holiday Rates: Services performed on official federal holidays will be billed at a time-and-a-half (1.5x) rate.
- Securing Service & Onboarding: First-time winter service customers must submit a $500.00 non-refundable, one-time deposit to secure their property placement for the winter season.
- Operations & Dispatch: The exact timing, required snow accumulation depths for deployment, and deployment of ice treatments are handled at the sole professional discretion of the Company based on real-time meteorological data. To maintain site safety, the Company is granted automatic authorization to pre-treat surfaces ahead of a forecasted freezing event or winter storm.
- Service Maps & Variations: Service boundaries are strictly locked in via an approved property plot map. Any requested alterations to the designated service area require 72 hours notice to take effect once submitted in writing.
- Parked Vehicles & Obstructions: The Company cannot plow or chemically treat areas blocked by parked vehicles or equipment. While operators will make reasonable efforts to clear safely around obstructions, blocked stalls or paths will remain unserviced until cleared.
- Hidden & Buried Hazards: While we exercise immense care, the Company is explicitly not responsible for structural or cosmetic damage to items that are buried, snow-covered, or otherwise not clearly visible (including low-profile landscape lighting, unmarked curbs, turf edges, or obstacles left in the service path).
- Winter Liability & Damage Windows:
- 48-Hour Reporting Rule: Any suspected property damage caused by winter equipment must be reported to our office in writing within 48 hours of the occurrence. Verified damages will be fully repaired by our team during the following spring season.
- Lawn & Concrete Performance: If plows displace lawn turf, the Company will re-seed the area in the spring. The Company is explicitly not liable for natural concrete pitting, cracking, scaling, or rust stains caused by underlying concrete minerals or environmental salt exposure.
- Slip & Fall Indemnity: The Company does not guarantee entirely ice-free environments and is not liable for personal injuries, medical costs, or claims resulting from slip-and-fall accidents on the premises.
- Winter Cancellation Policy: Either party may terminate the winter service agreement with a 30-day written notice. A $500.00 early termination fee applies if a full 30-day written notice is not provided prior to stopping service.
10. Satisfaction Guarantee
If you are unsatisfied with a maintenance service, you must contact us within twenty-four (24) hours. We will schedule a re-service at no additional cost. This applies to recurring maintenance only and does not apply to landscape/hardscape installations or winter services.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GREEN LAWN CARE & LANDSCAPE INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER UNDER THE APPLICABLE SERVICE AGREEMENT.
12. Marketing & Media Rights
The Company reserves the right to take photographs and video of the Property for quality control and marketing purposes. We will not disclose the Customer's full name or specific street address in any marketing materials without express permission.
13. Force Majeure
Neither party shall be liable for failure or delay in performing obligations due to circumstances beyond their control, including acts of God, extreme weather, government restrictions, or supply chain disruptions.
14. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Idaho. Any dispute not resolved through good-faith negotiation shall be submitted to mediation in Ada County, Idaho. Any legal action shall be filed exclusively in the courts of Ada County, Idaho.
15. Severability & Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in full effect. These Terms, along with the signed Estimate/Proposal, constitute the entire agreement between the parties.
